Ben Lopatin There must be two Mark Cuban blog posts being discussed; the one I read does not slam attorneys, accountants, their fees, or taxes, but matter of factly recognizes them as overhead. It's core thesis is a critique of *policy* that seeks objective X by policy A, which creates more bureaucratic conditions instead of policy B which merely removes existing bureaucratic impediments. I know of no businesses, my own or clients, which go out of their way to spend money on legal and accounting fees.

I would need to see details before believing Mark Cuban's proposition that legal and accounting fees prevent employers from hiring more people. Based on many years of business experience, I find it unbelievable. If a business is pushing the legal line, to carve a niche or gain a competitive advantage, that can be expensive. To blame this on policy is dishonest,I think.

stanweddle Ryan, I totally agree with your suggestions. Mark Cuban's post, however, I find to be total nonsense. I have operated numerous businesses and the most I have ever paid in prof. fees would not have added one employee. I can see how someone who started his first business with his former employer's business plan and clients, and who has been charged with insider trading could have higher than normal legal and accounting costs. A billionaire would get a good rate of return from professionals I think

In Silicon Valley many law firms take equity instead because they know it's way too expensive for an entrepreneur to pay an attorney when just starting.

When you go get angel or VC funding, the attorney fees start going through the roof.

Start up costs can be very large. Setting up a company where the objective is to attract investors or VC, will cost more. Same with intellectual property legal fees. I believe Mark Cuban's argument had to do with legal fees because of gov. policy. Regulation is getting worse with Homeland Security rules, but most compliance can be done in-house without legal representation or accounting expenses. Best to determine when an attorney is necessary vs convenient.

Ryan Healy Love this post by Mark Cuban http://bit.ly/beKsEb. The simplest way to create more jobs is to allow entrepreneurs to spend less on lawyers and accountants. Ill take it a step further and say the government should provide incentives for entrepreneurs that go beyond this. What if anyone who creates a successful business receives a break on student loans or even full forgiveness? Of course you define what "success" is, but imagine the innovation that could take place with a small incentive!

My trepidation comes from not understanding all the nuances to the tax code and being afraid to screw it up. Thus, the requirement of needing professional services.
@Thomas - Skepticism is healthy. I really would love to hear from someone who founded a startup and know what sort of pressure professional services cost them.

I'm told that if you have a good reason for them and IRS objects, you only owe the additional tax and interest on the additional tax. I'm seldom challenged on using this practice. Sometimes an accountant will be more conservative than necessary, especially when they are dealing with new regulations.
