Dan Canedo What are the most effective ways/best resources to learn about/gain expertise in a new legal field (ex: entertainment law) when transitioning from another field (ex: insurance defense)? Researching Supreme Court cases, practice guides, internships, etc? How do you show knowledge of the new field on your resume if you have no prior internships/work experience in that field? Ryan Paugh Throwing this out there for my Legal & Entrepreneurship friends >> A friend of mine keeps getting emails from a company overseas that has the same name as his company. They're threatening to sue him if he doesn't quit using their name. His company offers similar services. I'm pretty sure that they're just mad because their Google ranking sucks. Can they realistically try to attack my friends business even though they're in a completely different country?

For example, if you are the first to use a mark, but someone else registers it after the fact with the PTO, they don't necessarily trump your rights. In other countries, use isn't necessarily a prerequisite. As Jon noted, a lot of this will depend on whether either party has the mark registered, you can technically sue someone without a registration but your remedies are not nearly as good. The law can't adjust fast enough to the internet and most judges don't have a good handle on internet/computer issues so "cyber law" disputes sometimes end with decisions that seem counter intuitive. As always, this is all general information -- the specifics are going to make the difference, he should get it checked out.

I can speak from experience with TM/Internet infringement work that paying a little up front for some good advice (even though no one likes to pay legal bills) can be a lot cheaper than being hit with an infringement suit and/or losing a domain name. You can pass my info along if he's still trying to figure things out.

Jennifer Reck: For what it's worth (and this comes from my own perspective of recently deciding to back off a bit over the next year to figure out what I really ...MoreFor what it's worth (and this comes from my own perspective of recently deciding to back off a bit over the next year to figure out what I really want to do when I grow up) - I think that if your heart is in the traditional legal world (law firms, etc) then you should put your all into it but if you really want an alternative career, then you should go for it and not worry if you can go back to law in the future. I suspect that career issues are just going to be tougher from now on and we're more likely to succeed if we are focusing on what we really want to be doing.

Benita Talati Rebecca - the dilemna I face right now is that I have an interview on Monday for a non-legal position...and I want to practice law. I don't mind taking a temporary break while the market sorts itself out but I'm afraid this might hurt me when it does. Advice/suggestions welcome.

Rebecca Vandiver Benita, congratulations on passing the bar! That makes sense. If that is the case, I absolutely would focus on doing everything you can to stand out in the employment arena and network as much as possible. When networking offer to do something in return so it is a two way street. Perhaps you could offer to help a lawyer write an article for the bar magazine. Depending on where you are, the market could be saturated but if you know this is what you want to do stay involved in employment.

Rebecca Vandiver Nathan, the most effective networking I did in law school was contacting various law school and undergrad alumni in areas I was interested in and setting up lunch meetings - not going to events. That said, events for alumni and events on campus were more effective than going to CLE's were lawyers aren't expecting to see law students.

Benita Talati Hi Rebecca, Sorry I didn't respond right away but I was waiting to find out my Bar results. I passed it so I would absolutely love to practice law yet in my heart, I know employment law is what I truly want to do. Thus, finding a way to stay in the area of employment law using my legal background in this economy would be fine with me even if not directly practicing at a firm. Does that make sense?
